Lasting Power of Attorney (LPA)

A Lasting Power of Attorney (LPA) is a legal document which enables you to choose your Attorney (one or more) to act on your behalf if you are incapacitated or lose your  Mental Capacity to manage your affairs in the future.

Why do you need a LPA?

We cannot predict our future health. Accidents and ill health can happen at any stage. A LPA enables you to make a long term plan so that if you suffer some health events, you know that decisions on your Property, Finance or Health and Welfare is in the hands of those you have chosen and trust most to make the best decisions for you with the minimum fuss and expense and without the need for them to apply to the Court of Protection.

You can choose more than one person to either act together or make decisions on their own. They are legally required to act in your best interests.

Anyone over the age of 18 can set up a Lasting Power of Attorney therefore ensuring that the people that they want to act on their behalf can, should Mental Capacity be lost.

What happens if you do not have a Lasting Power of Attorney?

If you do not have a Lasting Power of Attorney and you lose the ability to deal with your affairs, financial decisions (such as paying bills) or welfare decisions (on your future care) do not automatically fall to the next of kin.  Therefore someone will need to apply to become a Deputy (an individual who applies to have the ability to make decisions for you in the absence of a LPA).

This will involve the individual’s time and financial cost of applying to the Court of Protection in order to act on your behalf and even compiling and filling yearly accounts. This can put additional stress on your loved ones at an already difficult time.

A LPA can dramatically ease time constraints and stress on your loved ones and leave them in a position to deal with your affairs easily in case the worst should happen.
